What Is Domestic Violence?
Under Georgia law, domestic violence is any act of violence that may otherwise constitute a criminal act—such as battery, assault, stalking, criminal property damage, unlawful restraint, and any other felony crime—between persons who have a special relationship to one another, such as:
- Past or current spouses.
- Persons who are parents of the same child.
- Parents and children.
- Parents and stepchildren.
- Parents and foster children.
- Persons who formerly or currently live in the same household.
In common occurrences, a domestic violence charge may also be brought between current or former boyfriends or girlfriends.
Despite being considered as a general criminal charge, domestic violence crimes are treated differently, and courts are empowered to impose restrictions upon defendants accused of domestic violence, even prior to any criminal conviction as a prophylactic measure. Consequently, it is critical that those accused of domestic violence crimes obtain the advice and assistance of an experienced lawyer as soon as possible.
