What to Keep in Mind When Talking to Insurance Adjusters
If you are involved in a personal injury claim, you may have to have one or more discussions with the insurance adjuster. You should always consult with an attorney before speaking with an insurance adjuster.
It is good to be cautious when discussing your claim. Even your own insurance carrier’s adjuster will be on the look out for information that may lower the value of your claim. This is part of their job, to ensure claims are not overpaid. That being said, everything you say may affect your case. With this in mind, you will want to make sure you avoid a few things when discussing your claim with the adjuster.
Write down the name and contact info of your adjuster. This will save time when calling back in the future and ensure your communications with the insurance company are as efficient as possible. It will also make it easier for you to follow up on your claim.
Give as little information as possible while still cooperating with what is required of you. If you are talking to your own insurance company, you may have to cooperate fully with questioning as per the terms and conditions of your policy. You can still stay objective and only offer factual information about the accident, not about how you felt things happened or what your personal feelings are.
If asked about your injuries, it is OK to be vague. If you are still in the beginning stages of your claim, you may not even know the full extent of your injuries. Your medical records are going to explain your injuries in detail, so just provide cursory information.
If you are talking with the other person’s insurance company, you may want to politely decline any questioning until you speak with an attorney. When speaking with any adjuster or insurance company representative, always remember that they will want to get information from you that may devalue your claim or even dispute liability.
