What Not to Say at the Scene of an Accident

Auto accidents are a common source of personal injury claims. Many people will be involved in an accident during their lifetime, but not everyone knows how important it is to refrain from saying certain things in the aftermath. You may have strong feelings or opinions you want to express after the trauma of an auto accident. Just make sure to steer clear of making any admissions of guilt or fault. Being apologetic, expressing guilt, or admitting fault can only hurt your case, even if you feel you are at fault for the accident. It is possible that the other driver is more at fault than you.

In such an instance, a public apology to the other driver can mitigate their percentage of the liability if recorded in a police or witness statement. You may receive less compensation in your claim as a result of this. It is hard to know where the fault lies without being in possession of all the facts. Do not apologize under any circumstances. It is OK to express concern for others’ safety. The other driver and the witnesses will most likely be asked if you apologized or took any blame when being questioned. Also, refrain from posting anything about the accident on social media sites. What you say online could be used as evidence against you if your case goes to trial.

Avoid disclosing specific information about your injuries at the accident scene. The responding officer may ask you if you are injured. He is not looking for an exact diagnosis. You may not be aware of all your injuries immediately after an accident. Do not tell the officer what you think is injured or how severe you think your injuries are. It is hard to know the extent of your injuries without a proper medical examination. Keep this in mind when speaking with insurance adjusters as well. Your medical records will document the extent of your injuries; protect your interests by remaining cautious when talking about the accidents or your injuries with anyone. Exchange only the information required of you by law at the scene of an accident. You are required to provide the other driver with your contact information and your insurance information. Your focus after the accident should be on exchanging this information and assisting anyone injured. Keep silent on all other matters until you can speak with a personal injury attorney.

At all times for the duration of my case, Tom demonstrated professionalism, confidence, and honesty. At no point was I pressured to make any one decision over another, but Tom did his best to inform me about the consequences and benefits of all of my options.
